Datuk Seri Mohammad Nizar Jamaluddin enggan melepaskan jawatan sebagai Menteri Besar Perak dengan alasan masih menyandangnya secara sah mengikut Perlembagaan dan Undang-Undang Tubuh Negeri Perak.

“Saya dengan rendah hati mohon derhaka dengan berkata kepada baginda ’patik sebagai MB dan pemimpin kerajaan, mohon tidak letak jawatan’.

Akan meneruskan tugasnya seperti biasa dan akan masuk pejabatnya hari ini.

Kerajaan negeri bersama pemimpin kerajaan campuran pembangkang akan memohon untuk menghadap Sultan Azlan Shah untuk merayu agar Dewan Undangan Negeri dibubarkan bagi membolehkan pilihan raya negeri diadakan.

POH: The political turmoil in Perak is far from over with Datuk Seri Mohammad Nizar Jamaluddin refusing to resign as mentri besar on the order of Sultan Azlan Shah, saying that the action by Barisan Nasional to grab control of the state is illegal.

He told a press conference this afternoon: "We are not rejecting the decision of the Sultan but pleading to the Tuanku for the dissolution of the state assembly.”

Nizar had an audience with the Sultan yesterday, and had submitted a letter in which he presented two arguments to justify his request for a dissolution.

He said the 28 members of the Perak State Assembly who are from the Pakatan Rakyat had taken a decision to call for the dissolution of the assembly and to get a new mandate from the rakyat.

The letter said both the PR and BN have the same number of assemblymen at 28, and that three former PR assemblymen were no longer members of the assembly.

It added that the Assembly Speaker had filed an application in the high court for a declaration that the trio -- Jamaluddin Mohd Radzi (Behrang), Mohd Osman Jailu (Changat Jering) and Hee Yit Fong (Jelapang) -- were no longer assemblymen.

"How can the BN then claim to have the majority to rule the state?” he asked.

Nizar requested Sultan Azlan Shah await the outcome of the application before deciding on the future of the Pakatan Rakyat state government.

However, he said, the Sultan asked him to resign.

Nizar said he told the ruler he would not and would only do so as per the State Constitution which stated that a Mentri Besar could only step down from his post if he willingly resigned, or does not get a vote of confidence from the state assembly.

He told about 150 reporters and photographers at his residence here at about 4.30pm, that he is still legally the mentri besar of Perak and that he will go to his office at the State Secretariat (SS) as usual tomorrow (Friday).

When told the police had sealed off the state secretariat, he said that will not stop him from performing his duties.

Nizar said when he rang up the State Secretary to ask why his office had been locked up, the official responded by saying: "I am in charge of the building now and you are no longer the Mentri Besar of Perak.”
